STAGE I
APPLYING FOR A DECISION ON LAND DEVELOPMENT CONDITIONS.
One of the most important acts of law according to the investment process is a local spatial management plan. However, not every community’s real estate resources are subject to the local spatial management plan. In that case, the investor should apply for a decision on land development conditions at the local community. This decision is necessary for every investment which requires a building permit.
STAGE II
ACQUISITION OF THE INVESTMENT AREA
Everyone has the right to inspect the local spatial and development plan and may obtain an extract and draw from the plan (for which an administration fee is charged). We encourage you to ask InVałbrzych to assist you at this stage.
The acquisition of land from municipal resources occurs through the purchase of real estate or other forms of acquisition of the right to dispose of the property for construction purposes (perpetual usufruct, lease). Matters relating to the acquisition of land are carried out by the appropriate party dealing with the sale of real estate in the municipality or given community. The purpose of the site shall be determined by the local zoning plans, such as local spatial development plans or, in the absence thereof, decisions on the land development conditions, and the location of the investment for the public purpose.
STAGE III
CONSTRUCTION PROJECT
The construction project, which should be attached to the application for a building permit, shall be drawn and prepared by a designer with qualifications in a particular specialty. The construction project should contain all the required opinions, arrangements, permits, and other documents specified in specific provisions.
STAGE IV
BUILDING PERMIT
A building permit is required if the investor is constructing or reconstructing the building object. This decision must be submitted to the proper County Executive.
Required attachments:
• Construction project (4 copies),
• Real estate investment purposes’ rights,
• Decisions on the land development conditions and location of the investment for the public purpose (if required).
STAGE V
EXECUTION OF THE INVESTMENT
The execution of the investment is launched after obtaining a building permit or reporting the construction to the relevant authority.
It is paramount to execute the investment in reference to the construction project, as well as the continuous supervision of the investment in regards to time, budget, and quality.
STAGE VI
OBTAINING AN OCCUPANCY PERMIT
This is the last stage of the investment. The occupancy permit, according to the Polish law, is necessary to use the building. To obtain an occupancy permit, the investor should request the proper District Building Supervision Inspector.
